Terms of Service

1. Acceptance of Terms

By accessing or using the EnrichLATAM API (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

EnrichLATAM provides an API that returns publicly available company data from Latin American jurisdictions, including but not limited to company enrichment data, KYB (Know Your Business) verification, and government tender information. The Service is provided by ENRICHLATAM SPA, a Chilean company (RUT 78.396.627-1), domiciled in Santiago, Chile.

3. API Access and API Keys

Access to the Service requires a valid API key. You are responsible for maintaining the confidentiality of your API key and for all activity that occurs under your account. You must not share your API key with third parties or use it in publicly accessible client-side code.

We reserve the right to revoke or suspend any API key that we reasonably believe is being used in violation of these Terms.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Resell, sublicense, or redistribute the raw API output as a standalone data product without prior written consent from EnrichLATAM.
  • Scrape or bulk-download data in volumes that exceed your subscription plan's rate limits.
  • Attempt to reverse-engineer, probe, or disrupt the infrastructure of the Service.
  • Use the data to engage in discriminatory practices, harassment, or any activity that violates the rights of individuals or entities.
  • Use the /owners endpoint or any data returned by the API to build profiles of natural persons, track the corporate activity of specific individuals across multiple companies, or for any purpose whose primary intent is the identification, monitoring, or scoring of natural persons rather than the due diligence of legal entities.

5. Data Sources and Accuracy

The data returned by the Service is sourced from official public registries. The primary sources are:

  • Chile — KYB & Enrich: Servicio de Impuestos Internos (SII), nómina pública de contribuyentes. Data is considered public information under Chilean Law 20.285 (Ley de Transparencia).
  • Brazil — KYB & Enrich: Receita Federal do Brasil, via OpenCNPJ. Data is publicly available under Brazilian federal law.
  • Chile — Tenders: Mercado Público (mercadopublico.cl), official Chilean government procurement platform operated by ChileCompra. Tender data is public information under Chilean Law 20.285 (Ley de Transparencia). Source attribution is included in all API responses.
  • Brazil — Tenders: Portal Nacional de Contratações Públicas (PNCP, pncp.gov.br), licensed under Creative Commons Attribution-NoDerivatives 3.0 (CC BY-ND 3.0).

Data freshness: Chilean company data (KYB and Enrich) may be sourced from a locally synchronized copy of the SII public registry, updated monthly. The API response includes a data_as_of field indicating the date of the last synchronization when applicable. Data may be up to 30 days old. EnrichLATAM does not guarantee the completeness, accuracy, or timeliness of the data. You are responsible for independently verifying any data before making business decisions based on it.

6. Subscription, Billing and Payment

Access to the Service is provided on a subscription basis. Pricing is as described on the EnrichLATAM website at the time of purchase. Payments are processed by our third-party payment provider (currently Paddle). All prices are in USD unless otherwise stated.

Subscriptions renew automatically unless cancelled before the renewal date. Refunds are not provided for partial billing periods.

7. Rate Limits

Each subscription plan includes a defined number of API requests per month. Requests beyond the included quota are billed as overages at the rates published on the pricing page. EnrichLATAM reserves the right to throttle or suspend API access if usage exceeds reasonable limits or poses a risk to service stability.

8. Intellectual Property

The Service, including its underlying software, documentation, and interface, is the proprietary property of ENRICHLATAM SPA. Nothing in these Terms grants you ownership of any intellectual property rights in the Service. The data returned by the Service originates from public sources and is not the intellectual property of EnrichLATAM; however, our compilation, normalization, and enrichment methodology is proprietary.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ENRICHLATAM SPA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of profits, data, or goodwill.

In no event shall EnrichLATAM's total liability to you exceed the amounts paid by you to EnrichLATAM in the three (3) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Termination

Either party may terminate the Service relationship at any time. Upon termination, your API key will be revoked and access to the Service will cease. EnrichLATAM may terminate or suspend access immediately, without notice, for any violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Chile, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Santiago, Chile.
